The government is still looking for a model to prevent foreclosure tsunamis that threatens after Oct. 18, when the moratorium on foreclosures expires, introduced due to special circumstances caused by the coronavirus pandemic. The three-month moratorium was first introduced on April 17, and after it expired in July, the government decided to extend it for another three months. The delay in enforcement in the first quarter was introduced for a total of 1,089,620 bases for payment, and they referred to 234,587 citizens and 10,269 natural persons performing a registered activity - craftsmen.
A series of objections
According to some unofficial estimates, after October 18, when the second moratorium expires, we could suddenly have about 400,000 citizens under foreclosure. To mitigate the blow, the government first considered allowing debt repayment in installments, but after several meetings with notaries and bailiffs, this was dropped. On the one hand, this model is not acceptable to bailiffs, and could cause practical problems. Namely, the judges commented that this could provoke a series of objections, which would move the cases to court and complicate their resolution.
According to unofficial information, there is currently a proposal on the table according to which executions would be carried out in two waves. The first would address those received by July 18, that is, in the first three months of the moratorium. These executions, based on an authentic instrument, would begin on October 19. In the second wave, the executions that arrived in the second quarter, between July and October, would be resolved, and they would start to be implemented from January 1, 2021. Enforcement that would arrive from October 25 onwards would be immediately put into procedure and carried out without any delay.

According to our information, the Government legally wants to resolve these issues by passing a decree with the force of law, and then it should enter into force on October 25 this year. Another meeting with notaries is to be held at the Ministry of Justice on this topic this week, at which the model should be considered and how feasible it is. Some notaries we spoke to say that these measures would give us a third mini moratorium, and they also see a problem in the fact that bailiffs who requested payment of their debt in May this year would wait in line until October, while those who will at the end of October just to initiate enforcement proceedings, to be in the procedure immediately.

Exactly how many executions will take place at the end of the year and how many citizens will be blocked cannot be known at the moment. During the moratorium on enforcement, which lasts a total of six months, 175,000 new requests for initiation of proceedings were submitted. The Government's plan of legislative activities includes amendments to the Enforcement Law. The previous concept of returning enforcement to the courts has been completely abandoned, with the retention of notaries public, and a completely new law will be written. However, in the first step, the existing one will be changed in order to facilitate the position of the debtor. This means that foreclosures on the apartment will not be possible in the winter and that the circle of income protected from forced collection will be expanded.
