The European Commission (EC) launched proceedings against the UK on Thursday for breach of the EU withdrawal agreement. The EC sent a warning letter to London, which is the first step in the procedure due to violations of Union rights. Britain has a month to respond.
If it is dissatisfied with it, the EC can send a reasoned opinion and if the problem is not resolved, file a lawsuit before the Court of Justice of the EU.
PARLIAMENT APPROVED THE BILL
The lower house of the British Parliament on Tuesday approved a bill that calls into question some of the UK's obligations under the disengagement treaty with the EU, despite threats from a Brussels court and disagreements within the Conservative Party.
Under the agreement, both parties must take appropriate measures to ensure compliance with the obligations arising from that agreement.
By enacting the impugned law, “the United Kingdom has breached its obligation to act in good faith, as provided for in Article 5 of the Separation Treaty. The EC is therefore instituting proceedings for infringement of Union law in accordance with the provisions of the disengagement treaty, "said European Commission President Ursula von der Leyen .
THE PROTOCOL ON CUSTOMS ARRANGEMENTS IS BEING AMENDED
The disputed law amends the protocol on customs arrangements for Northern Ireland, which was one of the most difficult issues in the disengagement negotiations. These announcements are of particular concern to Ireland, which is the only one with a land border with the United Kingdom, but also to Northern Ireland, which is part of the United Kingdom.
The disengagement agreement entered into force on 1 February 2020 and a key part of it is the Ireland / Northern Protocol, which aims to protect peace and stability on the island. At the same time, the last round of talks on future EU-Britain relations is taking place in Brussels this week, which have so far not resulted in any progress.
