THE CONSTITUTIONAL COURT CONCLUDES: Ivo Sanader's rights were not violated by pre-trial detention in the Ina-MOL case

The Constitutional Court concluded that former Prime Minister and HDZ President Ivo Sanader 's rights were not violated when he was sentenced to pre-trial detention after the invalid verdict in the Ina-MOL case, although he was already behind bars according to the final verdict in the Planinska case.
The Constitutional Court made such a decision rejecting Sanader's constitutional complaint, which appealed against the pre-trial detention that was imposed on him when he was convicted in a retrial at the end of 2019 for accepting bribes from MOL leader Zsolt Hernadi, who was inaccessible to the Croatian judiciary .

In addition to six years in prison, he was sentenced to the so-called compulsory pre-trial detention imposed by non-final sentences of more than five years.
Sanader first appealed the decision to the Supreme Court, which ruled that his pre-trial detention in the Ina-MOL case would begin after the execution of a six-year sentence in the Planinska case.
"At the same time, it is clear from the reasoning of the disputed decisions about the serving of the sentence in question, so the above does not create a state of legal uncertainty and legal uncertainty for the applicant," the Constitutional Court stated.
Unfounded claims
Therefore, he assessed as unfounded Sanader's claims that ordering pre-trial detention against him was pointless and that it was an expression of "excessive formalism contrary to the Constitution".
The Constitutional Court also assessed Sanader's allegations as unfounded, "repeating the appellate objections, stating that the prescribed maximum duration of pre-trial detention had expired in the specific case and that pre-trial detention could no longer be ordered against him," the Constitutional Court ruled.

The Zagreb County Court is nearing the end of the retrial in the Fimi media case, in which he was previously sentenced to nine years in prison, and his former HDZ party was fined five million kuna for withdrawing money from state institutions and companies. The invalid verdict in that case from 2013 was revoked by the Supreme Court in 2015
